The Prosecutor’s Office filed a motion on termination of lease agreement for a 3,100 sq. m land plot on the shore of Lake Sevan
The Department of State Interests Protection of the Prosecutor General’s Office has submitted a motion to the Director of the “Sevan” National Park SNCO and to the Chief Secretary of the Ministry of Environment for taking measures on termination of the lease agreement concluded on 20 October 2004 between the “Sevan” National Park SNCO and Arayik Hayrapetyan regarding a 3,100 sq. m land plot located on the shore of Lake Sevan.
Within the scope of its authority to initiate proceedings aimed at state (community) interests protection, the Department of State Interests Protection examined the lease agreement concluded between the SNCO and Arayik Hayrapetyan, together with the related documentation.
The review established that the lease agreement had originally been concluded until 8 April 2011; however, following the expiry of that term, it continued to remain in force for an indefinite period.
Based on the above, and pursuant to Part 2 of Article 612 of the Civil Code of the Republic of Armenia, which provides that where the term for lease is not provided for by the contract, the lease contract shall be deemed to be concluded for an indefinite term, either party may terminate the agreement at any time by giving the other party three months' prior notice, the Prosecutor General’s Office submitted a motion to the SNCO for taking measures to terminate the lease agreement.
