The Prosecutor’s Office demands to recover the real property at 8/1 Abovyan street, Yerevan, from the unlawful possession of a CJSC: Claim for state interests protection admitted for proceedings
October 08, 2026
On 18 September 2026, the Prosecutor General’s Office filed a claim with the Anti-Corruption Court against the State Property Management Committee, “Aviatrans” CJSC and “Foxford” CJSC, demanding to declare invalid the state property privatisation agreement concluded on 9 August 2001 between the Ministry of State Property Management and “Aviatrans” LLC and to apply the consequences of invalidity. Among other claims, the Prosecutor’s Office sought to oblige “Foxford” CJSC to vacate the real property located at 8/1 Abovyan street, Yerevan, from its unlawful possession.
Among other grounds for the aforementioned claim, the Prosecutor General’s Office relied on the fact that the privatisation of the state-owned real property located at 8/1 Abovyan street, Yerevan, which was the subject of a pledge, had been carried out by way of direct sale rather than through public auction, whereas, as of 9 August 2001, the legislature had established a clear and mandatory legal regime for the disposal of pledged state-owned property, namely, disposal through public auction.
By a decision of the Anti-Corruption Court dated 30 September 2026, the claim was admitted for proceedings. By another decision issued on the same day, an interim measure was applied with respect to the property to secure the claim: “Foxford” CJSC was prohibited from taking any action that could result in a change in the actual or legal status of the real property located at 8/1 Abovyan street, including alienating or mortgaging the property in any manner.
