On 14 September 2026, the Department of State Interests Protection of the Prosecutor General’s Office filed a claim with the Anti-Corruption Court against Abovyan community and individuals, demanding to have the auctions declared invalid, recover the property from another’s unlawful possession, and apply the consequences of invalidity.

In parallel with the criminal proceedings conducted under the supervision of a prosecutor of the Prosecutor’s Office of Kotayk region, the Department of State Interests Protection of the Prosecutor General’s Office carried out an examination for the protection of state interests. The examination established that the kindergarten building had been alienated despite the fact that the kindergarten had not actually been dissolved and had continued to operate, with a director and employees. Moreover, the property had been alienated to a limited liability company (LLC) whose director was the son of the kindergarten director.

Following the alienation of the kindergarten building, the LLC granted the community the right to use it so that it could continue to be used in practice by the kindergarten. It was also established that the property subject to alienation had not been fully appraised, and only part of it had been valued. Furthermore, on 7 July 2004, by adopting Decision No. 65-A on the alienation of the kindergarten owned by the community, the Abovyan Community Council of Elders had approved the sale price and terms of alienation. However, the Head of the Community deviated from the price and terms established by the decision of the Council of Elders. As a result, the agreement was concluded not at the price and on the terms set by the Council of Elders, but at the price and on the terms established by Decision No. 237 of the Head of the Community dated 26 July 2004.

By its judgment of 3 November 2026, the Court approved the settlement agreement concluded between the parties.

Under the settlement agreement concluded within the framework of state interests protection, land plots with a total area of 0.9167 ha, the kindergarten building with an area of 3,203.35 sq. m, and the adjacent buildings and structures, with an estimated market value of approximately AMD 1.24 billion, will be returned to Abovyan community of Kotayk region. The properties are located in Abovyan settlement of Abovyan community, Kotayk region.

The preliminary investigation in the criminal proceedings is ongoing.
