On March 25, 2024, the Prosecutor General's Office reported that the prosecutor had submitted the criminal proceedings regarding the accused who offered a bribe in exchange for voting in favor of the “Pativ Unem” alliance to the Anti-Corruption Court along with an approved indictment.
It should be reminded that under the criminal proceedings investigated by the Anti-Corruption Committee, it was revealed that on June 19, 2021, around 10:00 PM, K.Kh., a resident of one of the communities in the Ararat region, visited the apartment of A.V., a resident of the same community, and offered AMD 30,000 as a bribe for each vote in favor of the “Pativ Unem” alliance. The citizen rejected the offer. Additionally, K.Kh. had also offered a bribe to A.V.'s two daughters. One of them agreed to the offer and received a bribe of AMD 30,000.
K.Kh. had been announced wanted due to the fact that his location was unknown and he had been fleeing from the investigation, a search warrant was issued for him on July 1, 2021. By the judgment of the Court of First Instance of Yerevan dated July 2, 2021, detention was chosen as a measure of restraint against him.
On March 5, 2024, K.Kh. appeared at the Ararat division of the Police of the Ministry of Internal Affairs, where he was arrested and presented to the authority conducting the investigation. By the decision of the Anti-Corruption Court dated March 6, 2024, combined alternative measures of restraint were applied to the defendant K.Kh., including house arrest for 2 months, a bail of AMD 1 million, and a ban on absence.
By the judgment of the Anti-Corruption Court dated May 17, 2024, K.Kh. was found guilty and was sentenced to imprisonment of 4 years and 6 months. The sentence was not applied conditionally, and a probationary period of 4 years was set.
An appeal was filed by the Prosecutor General's Office against the non-application of the conditional sentence for K.Kh., but it was rejected by the decision of the Anti-Corruption Court of Appeals dated July 15, 2024.
A cassation appeal was then submitted by the Prosecutor General of the RA against the aforementioned decision of the Court of Appeals, which was granted.
In particular, by its decision dated April 10, 2025, the Court of Cassation modified the verdict of the Anti-Corruption Court dated May 17, 2024, regarding K.Kh., as well as the decision of the Anti-Corruption Court of Appeals dated July 15, 2024, regarding leaving the verdict unchanged. The Court annulled the conditional non-enforcement of the sentence imposed on K.Kh. in the form of imprisonment and allowed him to serve a term of imprisonment of 4 years, 1 month and 17 days.
