Helsinki Citizens' Assembly - Vanadzor issued a statement through means of mass media on February 18, 2025, stating, inter alia, that the Republic of Armenia is preparing to extradite Emil Torosyan, a citizen of the Russian Federation of Armenian descent: “The previous week, the citizen applied to the Migration and Citizenship Service with a request to seek asylum. The RA Prosecutor's Office, without waiting for the Migration Service to receive the application and initiate proceedings on it, made a decision to extradite E. Torosyan, which will result in a gross violation of his rights envisaged by the European Convention on Human Rights and Fundamental Freedoms."
In response to this publication, the Prosecutor General's Office of the Republic of Armenia states that Emil Torosyan, a citizen of the Russian Federation, was properly notified in a language understandable to him on May 21, 2023, of his right to apply to the Migration and Citizenship Service of the Ministry of Internal Affairs (hereinafter referred to as the (MCS MIA) to seek asylum or refugee status in the Republic of Armenia, but did not exercise this right and did not submit such an application to the relevant authorized body within the foreseen period.
On June 20, 2024, Emil Torosyan was arrested by the competent authorities of the Republic of Armenia, and on July 12, 2024, a decision was made by the Prosecutor General of the Republic of Armenia to authorize extradition.
The above-mentioned decision was delivered to both Emil Torosyan, in a language understandable to him, and to his defendent.
On July 22, 2024, Emil Torosyan's defense attorney filed an appeal against the decision to authorize extradition on the grounds that Emil Torosyan is a citizen of the Republic of Armenia, which was rejected by the Criminal Court of Appeal on August 7, 2024.
A special cassation appeal was filed against the above-mentioned decision of the Court of Appeal, which was rejected by the decision of the Court of Cassation on February 7, 2025.
The decision of the Court of Cassation established that the claims of the defense party regarding Emil Torosyan's recognition as a citizen of the Republic of Armenia do not correspond to reality.
