S.Kh. holding the position of the director of “Dzorak” care center for people with mental health problems SNCO (hereinafter referred to as “the Center”) from December 27, 2014 until March 26, 2020, required and received bribe in large amounts.
In particular, for the purpose of issuing a power of attorney for selling 2/3 of the apartment (located at Gyulikekhvyan street, city of Yerevan,) belonging to A.T. one of the wards of the Center, in September 2019, during the meeting in his office A.T. demanded a bribe in the amount of USD 6000 from the aunts of the ward—V.T. and E.T., and came to the agreement with them about receiving USD 2000 before issuing the power of attorney and the rest after the sale of the apartment.
The Director of the Center S.Kh. received USD 2000 pursuant to the abovementioned agreement and without having the relevant permit of the commission of trusteeship and custodianship (the Center, being A.T.’s guardian has no right to conclude alienation agreement of the property belonging to A.T. without the permit of the commission of trusteeship and custodianship) issued a power of attorney for the term of 2 years pursuant whereto V.T. the aunt of A.T. can act as a representative of A.T.’s interests.
On July 6, 2020 an immovable property sale and purchase agreement was signed for AMD 12 million 63 thousand, however 2/3 of the agreement was not given to A.T. or the Center which is the guardian of the latter.
On September 12, 2024, on the initiative of the prosecutor, a public criminal prosecution was initiated against S. Kh. under points 2, 3 of part 2 of article 435 of the Criminal Code as well as under part 1 of article 309 of the Criminal Code adopted on 18.04.2003.
On September 24, 2024 the prosecutor signed the indictment regarding S. Kh. and submitted to the competent court with the materials of the proceedings.
