In the framework of the examination of the protection of state (community) interests by the Prosecutor's Office of Malatia-Sebastia administrative district, cases of alienation of land not subject to alienation to citizens and legal entities with ownership rights were recorded.
In May-June 2023, the Prosecutor's Office filed 11 statements of claim to Administrative and Anti-corruption courts of the Republic of Armenia.
In particular:
- By the decision of Yerevan Mayor, dated November 16, 2011, the unauthorized premise with an area of 571.8 sq. m., built on a 290.0 sq. m. land parcel of the park named after Vahan Zatikyan, located at 22 Raffi stereet, was considered the property of Yerevan, and in the next year, M.Sh., acquired the land parcel and premise as property. In order to invalidate the decision adopted in violation of the requirements of the legislation, the Prosecutor's Office filed a statement of claim to the Administrative Court.
- According to decision 3388-A of Yerevan Mayor, dated July 22, 2010, the land parcels of the “Italian” park located at Andranik 121/8, and by decision 2480-A, dated May 17, 2013, were alienated in the event that, on the basis of Clause 6 of Article 60 of the Land Code, it is forbidden to transfer ownership of lands for common use in settlements to citizens and legal entities. The Prosecutor's Office of Malatia-Sebastia administrative district filed 3 statements of claim to the Administrative Court with the demand to declare the decisions of Yerevan Mayor invalid.
- 2 statements of claim were filed to the Anti-Corruption Court, demanding the demolition of unauthorized premise at Andranik 43 and adjacent areas, as the unauthorized premise were not subject to legalization due to the restrictions of the Land Code.
- According to decision 799-A of Yerevan Mayor, dated May 11, 2004, the "Shogher" nursery-kindergarten with its 8760 sq. m. land parcel, located at 304 Babajanyan Street was allocated to Malatia-Sebastia district community with the right of use. According to the decision of the community council, dated September 17, 2004, it was alienated to “A. Khalatyan College” LLC. Statements of claim were filed to the Administrative and Anti-Corruption Courts.
- According to decision 113-А, dated April 16, 2008, Malatia-Sebastia community council allocated the 0.515193 ha of land, located at 29 and 29/3 Jambul Street in Yerevan to A.H., under the conditions of the prohibition of Article 60 of the Land Code. In the course of the initiated criminal proceedings, it was confirmed by the expert's conclusion that the above-mentioned land parcel was intended for electric transmission lines. The Administrative Court accepted into proceedings the statement of claim for annulment the decision of the Council of Elders of Malatia-Sebastia community, dated April 16, 2008 and for the cancellation of the state registrations of rights and records of registry book made in the Cadastre Committee.
- On June 13, 1990 and on October 24, 1997, some land users in Hagtanak district were granted state acts of land ownership rights by Shahumyan district's Hagtanak village council, affixed with the seal “ARMENIA YEREVAN’S MALATIYA-SEBASTIA DISTRICT COMMUNITY LLC”. The community municipality of Malatiya-Sebastia did not have the organizational and legal form "closed joint-stock company" and could not contain the record "CJSC". In 2022 the land users submitted state acts of property rights to the Yerevan Municipality. In June 23, 2023, the Prosecutor’s Office of Malatiya-Sebastia Administrative district filed a statement of claim to the Administrative Court.
