The Prosecutor General has revoked the decision rendered on termination of the criminal prosecution in the case of the death of a conscript in the N military unit of the Ministry of Defense in 2018. The criminal proceedings have been submitted to court

On October 24, 2025, the Prosecutor General decided to revoke the decision of December 16, 2021 on termination of the criminal prosecution against V.H., Junior Sergeant of N Military Unit of the Ministry of Defense (MoD). A new public criminal prosecution has been initiated against V.H.

 

It should be recalled that on May 6, 2018, the body of conscript soldier, private L.T., was discovered at a combat position located in the defensive sector of MoD N military unit, with a penetrating gunshot wound to the lower jaw and the top of the head. The investigation established that during the period from May 1 to May 6, 2018, while on combat duty, junior sergeant V.H., who was L.T.’s superior, had repeatedly insulted him, used violence against him, and threatened to use violence.

 

On May 14, 2018, V.H. was charged under part 2 of Article 360 of the Criminal Code adopted on April 18, 2003 (insulting a serviceman – 3 counts). However, on December 16, 2021, the criminal prosecution against the accused was terminated on the grounds that the statute of limitations for criminal liability had expired, whereafter the proceedings were suspended.

 

On October 27, 2022, a decision was rendered to resume the suspended proceedings, and an additional posthumous outpatient forensic psychiatric and forensic psychological comprehensive examination was assigned.

 

On July 22, 2025, the prosecutor initiated new public criminal prosecution against V.H. under part 5 of Article 520 of the Criminal Code (violence against a subordinate or threat of violence that negligently resulted in a person’s death).

 

On August 1, 2025, the conclusion of the additional posthumous outpatient forensic psychiatric and forensic psychological comprehensive examination was received, according to which “there is a causal relationship between L.T.’s psychological condition during the period preceding the incident and the events, and such a psychological condition could have contributed to the decision to commit suicide.”

 

On October 21, 2025, based on the results of the preliminary proceedings, the prosecutor submitted a motion to review the legality of the December 16, 2021 decision to terminate criminal prosecution against V.H. for insulting L.T., and subsequently, the RA Prosecutor General decided to revoke the decision of December 16, 2021 on terminating the criminal prosecution.

 

On October 27, 2025, the charges against V.H. were amended and supplemented, and a new public criminal prosecution was initiated against him under part 5 of Article 520 of the Criminal Code.

 

On March 5, 2026, the supervising prosecutor approved the indictment against V.H. and submitted the files of the criminal proceedings to the competent court.
