One of the residents of Aragatsotn region, without having any legal basis for exemption from the compulsory military service, evaded 2021 military call-up (winter) and was recognized as unfit for military service and afterwards registered in the reserve by using a diagnosis issued to another person.
It was revealed by the criminal proceeding examined in the Investigative Committee that S.M., born in 2003, submitted a statement to Territorial Division of Conscription and Mobilization Service of Aragatsotn region of the Ministry of Defense (hereinafter referred to as “the MD Territorial Subdivision) confirming that the latter was diagnosed with the disease included in the list of diseases approved by the decision of the Government (under the criminal proceeding it was found out that the statement referred to another person, who applied to the medical institution with a fake passport). In order to check the disease, mentioned in the document, the doctor-specialist of the medical commission of the MD Territorial Division gave S.M. a referral for supplementary examinations in the same medical institution, where the abovementioned person gave a sample instead of S.M. with a fake passport. Based on the fact that the disease was confirmed, by the conclusion of the central medical commission of January 27, 2022 S.M. was recognized as unfit for the compulsory medical service and was registered in the reserve.
A public criminal prosecution was initiated against S.M. under point 2 of part 2 of article 327 (evasion of compulsory military service by forgery of a document or other means of deception) of the Criminal Code adopted on 18.04.2003.
On December 18, 2024, the Prosecutor signed the indictment regarding S.M. and submitted to the First Instance Court of General Jurisdiction of Aragatsotn region with the materials of the case.
