In the scope of the powers of initiating a claim on the protection of state (community) interest the Prosecutor’s Office of Kentron and Nork-Marash Administrative Districts of the city of Yerevan examined the alienation process of the building located at Abovyan 8 Str..

 It was found out under the examination, that by the decision of the Government dated June 16, 2005, the territory with the surface of 638.2 m², located at 8 Abovyan Str.,  city of Yerevan, the cadastral value whereof amounted to AMD 178 million 464 thousand and which was not subject to alienation, was alienated to Progress Armenia LL Company (businessman S.M. and his wife G.K. are the shareholders of that company) through direct sale for AMD 32 million 170 thousand 500, for the price five times lower than the real cadastral value of that territory.

One year after the purchase of the property, on March 31, 2006 S.D. Head of the Department of Architecture and Urban Planning of the Municipality of Yerevan issued an official document to S.M. Director of Progress Armenia LL Company containing false information pursuant whereof the land plot occupied by the Aesthetics center building was not included in the list of restrictions provided for by article 60 of the Land Code. However, pursuant to the decision of the Government dated October 7, 2004 the building located at the same address was included in the list of immovable monuments having historical or cultural value.

Besides that, pursuant to the contract, the Company obtaining the property undertook an obligation of making an investment in the amount of at least AMD 90 million until the end of 2006, however failed to make the investment and the officials failed to take measures to confiscate the property belonging to the buyer under the right of ownership for a long time.

Taking into consideration the fact, that during the examination, a case of an alleged crime was revealed, the prosecutor submitted a crime report to the Anti-corruption committee.

 On December 20, 2023 a criminal proceedings was initiated in the Anti-corruption committee under part 2 of article 308, part 2 of article 315, part 1 of article 314 of the Criminal Code adopted on 18.04.2003.

In the scope of the powers of initiating a claim on the protection of state (community) interest the Prosecutor General’s Office is undertaking measures for returning the property belonging to the community back to the community.
