In 2004, A.G., the former Head of Malatia-Sebastia district of Yerevan, with the aid of the members of the community council, abused his official powers, used his official position against the interests of the service and the community, negligently causing grave consequences.

In particular, by the decision of the Mayor of Yerevan, dated May 11, 2004, the “Shogher” nursery with a total land area of 8760.0 square meters was provided to the Malatia-Sebastia district with the right of free (permanent) use.

According to the property right certificate issued to the Malatia-Sebastia district on June 25, 2004, the nursery was not the property of the community; therefore, the community had no right to alienate it.

Despite the prohibition stipulated by the law, on September 17, 2004, A.G., the Head of the Malatia-Sebastia district of Yerevan, presented the proposal to alienate the kindergarten No 304 on Babajanyan street to the members of the community council through direct sale.  

On the same day, the council members approved the direct sale of the manger kindergarten on Babajanyan street, “A. Khalatyan College” LLC.

On October 29, 2004, the District Administration, on behalf of A.G., the Head of the community and “A. Khalatyan Varzharan” LLC, on behalf of A.Kh., signed a real estate sale agreement. The nursery  was sold to “A. Khalatyan College LLC for 30 million drams. meanwhile, the real value of the property in the given period was AMD 295 million.

Then, by the order of A.G., the Head of the community, on December 17, 2004, the nursery No 304 of Malatia-Sebastia district was dissolved.

On October 19, 2023, the Prosecutor initiated public criminal prosecution against A.G., under Part 2 of Article 308 of the Criminal Code adopted on April 18, 2003 (abuse of official authority, which inadvertently caused grave consequences).

In the near future, the Prosecutor's Office will submit a claim to the Anti-Corruption Court with the demand to declare the real estate sale contract invalid.
