Real estate in the center of Yerevan was alienated to the "Local Developers" company in violation of the law. Following a prosecutor's investigation, criminal proceedings have been initiated

On February 19, 2009, property located at 50a Eznik Kohbatsi Street was sold to the "Local Developers" company without a public tender, through a direct sale.

 

Within the scope of their authority to initiate a claim, the Prosecutor's offices of the Kentron and Nork-Marash administrative districts of Yerevan studied the process of alienation of the territory located at 50a Eznik Kohbatsi Street in defense of state (public) interests.

 

During the investigation, it was revealed that by a government decree dated March 1, 2007, the administrative building located at 50a Eznik Kohbatsi Street in Yerevan was declared an object of exclusive public use, as the beautification of the area in Yerevan would create green spaces, update engineering and technical infrastructure, etc.

 

By the government's decision of August 28, 2008, the mayor of Yerevan participated in the process of alienating state property.

 

According to the decision of February 19, 2009, the buyer of the property at 50a Eznik Kohbatsi Street was the company SP "Local Developers," of which 50% belonged to businessman S.M., and the remaining 50% belonged to his wife, the former rector of the State Medical University, G.K.

 

By the government's decision of August 29, 2013, the specified territory was once again recognized as exclusively public.

 

As of today, municipal property remains unchanged, and the alienation process was violated.

 

Based on the factual data obtained during the investigation, the Prosecutor's Offices of the Kentron and Nork-Marash administrative districts of Yerevan submitted a report to the Anti-Corruption Committee on September 18, 2023, to initiate criminal proceedings.

 

Criminal proceedings have been initiated under Part 2 of Article 308 of the Criminal Code, adopted on April 18, 2023 (abuse of official powers resulting in grave consequences due to negligence).

 

The Prosecutor General's Office, within the scope of its authority to initiate legal action in defense of state interests, will consider the possibility of filing a lawsuit in the Administrative Court with the aim of returning the territory to the municipality.
