Misak Manushyan park and the legality of operation of the filling station (hazardous production facility) located at the intersaction of Yeznik Koghbatsi and Arami streets were examined in the Prosecutor’s Office of Yerevan city in the scope of its power to submit a claim to the court with regard to protection of state (community) interests.
It was found out by the examination, that “Gor Evinyan” IE sold liquid fuel in the occupied land plot belonging to the community, without any urban planning or design document and with gross violation of the requirements of technical safety legislation.
Particularly, the business entity didn’t have any right in regard to the land plot, constructed the filling station without having any permission of urban planning document. Besides that, the territory of the station was not separated from the streets and carriageway with a safety zone, the width whereof must be 1.5 m. The Public building in front of the filling station was 14 m. far instead of the defined 25 m and 2 containers of the fuel with a total volume of 12 tons were placed in the park, covered with artificial grass.
Despite the abovementioned circumstances the filling station has been operated by “Gor Eviyan” IE for years and from 2018-2021 by “Elf-Group” LL company.
Thus, It was found out by the examination, that the filling station received positive expert opinions of the relevant experts despite numerous violations of the requirements of technical safety legislation, it also received a permission for activity from the person holding the position of the head of the administrative district at that time, despite the lack of the certificate of state registration of rights to immovable property.
On August 21, 2023 the prosecutor reported a crime to the Anti-corruption Committee.
On August 23, 2023 a criminal proceedings was initiated in the Anti-corruption Committee under part 1 of Article 445 and part 1 of Article 446 of the Criminal Code.
