Based on the article published on the internet magazine “Hetq”, an examination was initiated in the Department for Cases of Crimes against State Power of the RA Prosecutor General’s Office regarding payment terminals located on the land parcels owned by Yerevan community.
As a result of the examination, it was found that on April 4, 2013, a purchase agreement for the provision of services to the organization of car parks in Yerevan was signed between Yerevan Municipality and the consortium of "Locator" and "Parking City Service" CJSC. Within the scope of the contract, the agreement signed on July 10, 2014 stipulated the installation of payment acceptance terminals in the areas immediately adjacent to the car parks. In order to install the terminals, based on the decisions of Yerevan Mayor, 235 land parcels were separated in different administrative districts, but the procedure and conditions for providing the said land parcels for use were not regulated, nor were the payments for them regulated.
According to the examination carried out by the General Prosecutor's Office, it was found that 1296 terminals have been installed on the sidewalks of the Yerevan community, that is, on the land parcels owned by the community, without any basis.
It was also found out that in 2017, a service provision contract was signed between "Parking City Service" CJSC company and "Easy Pay" CJSC, to which "Easy Pay" CJSC committed to pay 5 million 958 thousand AMD to “Parking City Service" CJSC for the 300 payment terminals.
In other words, the installation fee for one terminal was 19 thousand 860 AMD, which means that for years the community was actually deprived of the opportunity to receive about 19 thousand 860 AMD per month for each installed terminal, which is 25 million 738 thousand 560 AMD per month, and about 926 million 588 thousand 160 AMD in 3 years calculation.
Taking into account that alleged data was acquired rergarding the negligent attitude towards the performance of official their duties by the employees of the Yerevan Municipality, causing damage of 926 million 588 thousand 160 AMD to the community, the Prosecutor General’s Office submitted a report on the crime to the Investigative Committee.
Based on the report, criminal proceedings were initiated on August 2, 2023 under Part 2 of Article 315 of the Criminal Code adopted on April 18, 2003 (official negligence).
