Based on the information received from the Ministry of Culture of the Republic of Armenia, Yerevan Municipality and the Committee on State Property Management of the Republic of Armenia in the Department of State Interests Protection of the RA General Prosecutor's Office the circumstances of the demolition of the building under state protection on Aram street 9 have been studied.
During the investigation it turned out that by the decision of the Government of the Republic of Armenia dated October 7, 2004, building on Aram street 9, included in the list of immovable historical and cultural monuments of Yerevan, which is a monument of republican value has been demolished by permission of officials of the Yerevan Municipality and as a result of the failure of relevant officials of the Ministry of Culture of the Republic of Armenia to exercise their functions of monitoring the protection and use of monuments.
Although, according to Article 21 of the RA Law “On the protection and use of immovable historical and cultural monuments and the historical circle”, the demolition of monuments of republican value is prohibited.
Taking into account that the recorded violations contain signs of a crime of abuse of official authority and, thus, have entailed grave consequences, a criminal case has been initiated in the Department of State Interests Protection of the RA General Prosecutor's Office on grounds of p. 2 art. 308 of the RA Criminal Code.
The preliminary investigation of the criminal case is entrusted to the RA Investigative Committee.
Note: Every person suspected in or charged with a criminal offense shall be presumed innocent unless proved guilty in the manner prescribed by the RA Criminal Procedure Code and unless the verdict comes into legal force.
