In the result of the investigation undertaken by the Prosecutor's Office of the Ajapnyak and Davtashen Administrative Districts of Yerevan within the framework of the authority to protect state (community) interests it was found out that the recreation area located at the intersection of Margaryan and Halabyan streets in the Ajapnyak Administrative District of Yerevan City was leased to a limited liability company (hereinafter: the Company). A land plot with a total area of 511.36 square meters was leased according to the decision of the Mayor of Yerevan of August 23, 2019 and the land lease agreement signed on August 28, 2019. The annual rent for the land plot was AMD 1 million 350 thousand.
The investigation conducted by the Prosecutor's Office revealed that as of April 23, 2024, there was an overdue liability of AMD 7 million 512 thousand regarding the budget of the city of Yerevan. It was also found that according to Clause 1.3 of the Agreement, the Agreement is valid until August 22, 2022 and according to Clause 15 of the same Agreement, the term of the lease right is set by the Lease Agreement until May 22, 2027.
The undertaken study has shown that the term of the lease right in the above-mentioned contract is set for a longer period than the term of the contract itself and the approach does not come from the requirements of the Civil Code.
Aimed at undertaking measures to eliminate the causes of the violations recorded against community interests and the conditions conducive to them, the Prosecutor's Office sent a corresponding petition to Yerevan Municipality on May 10, 2024, in response to which it appeared that measures were being taken to eliminate the existing violations.
In the result of the study, it was also found that the Company made a payment of AMD 715 thousand only in August 2019. On May 10, 2024, a special warning was addressed to the Company's director regarding the need to fulfill the existing obligation in a short time, but any step hasn’t been taken in this direction.
On June 21, 2024, the Prosecutor's Office of Ajapnyak and Davtashen Administrative Districts of Yerevan filed a lawsuit to the Anti-Corruption Court against the Company to confiscate AMD 7 million 512 thousand in favor of the budget of Yerevan community.
By the decision of the Anti-Corruption Court of December 2, 2024, the lawsuit of the Prosecutor's Office was granted. AMD 6 million will be confiscated from the Company in favor of Yerevan community.
