Having held the position of the Director of the “Karen Demirchyan Yerevan Subway” CJSC (hereafter refered to as “the Metro”) from 2008 to 2019, P.Y., committed large and particularly large-scale embezzlement by abusing his official position.
Particularly:
- On September 1, 2008, P.Y. signed an employment contract with his son, on the basis of which, his son held the position of the Deputy Head of the “Communication and Signaling” branch of the Metro, and from August 4, 2014 - the Head of the same branch. With the support of the Chairman of the Metro Board of Directors, P.Y., received the unanimous approval of the Board members regarding the alienation of the 944.5 sq. m. basement floor of the 76 Baghramyan Ave. building of the Metro. Based on the Board of Directors’ letter, on August 20, 2013, the Yerevan Mayor applied to the RA Prime Minister, proposing to instruct the relevant state institution to submit the mentioned area for alienation through public auctions. On October 23, 2013, the property appraiser of the “State Property Inventory and Assessment Agency” made a false assessment report. According to the mentioned report, the market value of the 944.5 sq. m. area amounted to AMD 106 million 850 thousand as of October 12, 2013. The appraiser intentionally did not include the land parcels with the areas of 0.19459 ha and 0.0038736 ha allocated for the area of the basement and their market values in the mentioned document. As a result, the property with a real market value of AMD 194 million 880 thousand as of October 12, 2013 was estimated at AMD 106 million 850 thousand. On December 4, 2013, the real estate was put up for auction with a starting price AMD 106 million 850 thousand. No one (including the Metro Director’s son) participated in the first and second auctions held on December 4, 2013. The property was not sold at auction. The Metro Director’s son bought the real estate during the third auction, on December 26, 2013, for AMD 75 million 393 thousand.
- The Metro Director stole AMD 7 million 104 thousand with the support of his son, and AMD 38 million 505 thousand with the support of his son and the latter’s friend working in the Metro.
- The Metro Director, at the request of the former Deputy Secretary of the Yerevan Municipality, hired three drivers who did not actually work for the company, but instead served the above-mentioned official of the Municipality and his family members as drivers for years. In the period from August 2012 to October 2018, AMD 11 million 147 thousand was paid to the three drivers from the budget of the Metro, AMD 11 million 887 thousand was allocated for petrol, and AMD 5 million — for vehicle. As a result, the Metro Director wasted about AMD 28 million.
- The Metro Director stole 110 thousand liters of petrol worth AMD 39 million 963 thousand AMD in different batches every month from October 2009 to March 2019.
- On July 1, 2015, the Metro Director employed a citizen who did not attend work, did not fulfill his duties, but received a salary of AMD 7 million 120 thousand from the budget of the Metro during 2015-2018.
- On May 27, 2011, the Metro Director hired another citizen, who also did not attend work, but received a salary of AMD 4 million from the company's budget during 2011-2014.
- On August 4, 2017, the Metro Director in violation of the requirements of the Law “On Procurement”, without announcing and holding a tender, on behalf of the Metro, signed a contract with the Armenian branch of a company, which was identical to the subject of the contract signed in the previous year, but the value of the contract was more in Euros 220 thousand.
On September 12, 2024, the Prosecutor initiated a public criminal prosecution against the Metro Director according to Point 1, Part 3 of Article 179 (7 counts) of the Criminal Code adopted on 18.04.2003, Points 2 and 3, Part 2 of Article 256 of the current Criminal Code, and against the latter's son — according to Point 1, Part 3 of Article 38-179 of the Criminal Code adopted on 18.04.2003 (two counts). Public criminal prosecutions were initiated against five more persons.
AMD 5 million bail was chosen as an alternative measure of restraint against the director of the Metro, and a written undertaking not to leave the country — against the son of the director of the Metro.
On October 15, 2024, the Prosecutor approved the indictment and submitted the proceedings' files to the Anti-Corruption Court.
A property claim will be filed during the preliminary hearings.
