On September 12, 2024, the Anti-Corruption Chamber of the Court of Cassation published the decision made in the criminal case No. ED/0253/01/19 (according to the accusations against Robert Kocharyan, Seyran Ohanyan and others), by which it overturned the decision of the Court of General Jurisdiction of Yerevan City on April 6, 2021 to stop the criminal prosecution initiated against Robert Kocharyan, Seyran Ohanyan, Armen Gevorgyan and Yuri Khachaturov under Article 300.1 of the Criminal Code adopted on April 18, 2003 and sent the case to the Anti-Corruption Court for a new examination.
The Court of Cassation, inter alia, recorded that under the existing conditions, the decision of the Court of First Instance to stop the criminal prosecution against Robert Kocharyan, Seyran Ohanyan, Armen Gevorgyan and Yuri Khachaturov is not legal, and that the Constitutional Court found Article 300.1 of the Criminal Code to be unconstitutional and invalid and after being recognized declared inconsistent and void, before the court would leave for the deliberation room, the accuser had the right to change the legal assessment of the guilt of the mentioned persons.
In response to inquiries received from the media, we would like to inform you that considering that the actions attributed to Robert Kocharyan and others have the features of a crime under another article of the Criminal Code, the prosecutor in the above-mentioned criminal case will submit a relevant decision to the Anti-Corruption Court in the near future.
