The land parcel of the former department store “Mankakan Ashkharh” was privatized in violation of the law. Based on the report of the Prosecutor's Office, criminal proceedings were initiated

In The Department of State Interests Protection of the Prosecutor General’s Office, the documents regarding the privatization of the 6198 square meter land parcel of the former “Mankakan Ashkhar” department store located at 32 Arami Street in Yerevan were examined.

 

The examination revealed that for alienating the building of the former department store “Mankakan Shkhar” through an open auction or a direct sale, which is a historical and cultural monument — donated to the Kentron community of Yerevan, was alienated on September 6, 2001, under the direct sale contract signed between the Kentron district community and “Soglasiye-Armenia” LLC. The said company was registered in the state register of legal entities on August 31, 2001, a few days before the alienation.

 

On October 4, 2001, a 99-year lease agreement was signed between the Mayor of Yerevan and "Soglasiye-Armenia" LLC in violation of the law for a land parcel with an area of 6,198 square meters.

 

Later, on March 4, 2002, the State Real Estate Cadastre Committee under the Government, based on Clause 7 of Article 118 of the Land Code, registered the ownership right of “Soglasiye-Armenia” LLC to the land parcel with an area of 6198 square meters, located at 32 Aram Street. Meanwhile, the above-mentioned company was not registered as a legal entity in the Republic of Armenia during the period defined by the Land Code. Therefore, until May 2, 2001, it could not have the right of use over that land parcel, acquire the right to rent it, which would enable it to acquire the ownership right over the land parcel on the condition of paying the cadastral value of the land in full. As a result, the ownership rights of the state over the 6198 square meter land parcel, located at 32 Aram Street have been illegally terminated.

 

Taking into account that during the examination an alleged crime was discovered, the Prosecutor submitted a crime report to the Anti-Corruption Committee.

 

On October 10, 2023, criminal proceedings were initiated in the Anti-Corruption Committee under Part 1 of Article 441 of the Criminal Code.
