During 2008-2015 K.G. holding the position of the head of Abovyan city, being informed on the legal prohibition (land plots constituting state and community interest—parks, gardens and other territories of common use  that must not be transferred to citizens and legal persons under the ownership right) used his powers against the state and official interests, violated several legal acts’ requirements and alienated land plots.

         Particularly.

1. G. former head of Abovyan city violated the requirements of article 60 of the land code and disregarded the requirements of the Government’s decision regarding the approval of the master plan of Abovyan city.
2. Data were obtained under the proceedings that K.G. being informed that, the land plot with the surface of 2020 m² located at 1/80 Kotayq city of Abovyan, not subject to alienation has a historical and cultural value, alienated the property to himself.
3. G. violating the requirements of article 60 of the Land Code alienated water basin and the land plot separated for its maintenance to M.M. deputy of Prosperous Armenia Party.
4. G. alienated the park with the surface of 768.5 m² not subject to privatization to K.K. with the help of M.H., his assistant and S. Kh., Head of Municipality Urban Planning Division.
5. KG, having the obligation to stop the arbitrary occupation of state or community-owned land plots by citizens or legal persons and to eliminate its consequences, failed to take any measure to demolish the 79.6 square meter guard house, the 168.7 linear meter wall, as well as the 6.1 meter diameter fountain. Instead he committed official forgery, failed to include the fact that the plot was burdened with construction in the plan and gave the plot with an area of 7175.83 m² for a long-term lease to the "Old Parvana" LL company owned by his family at a low price.
6. G. abused his powers and committed money laundering with the help of the officials of the municipality.
7. G. changed the purpose of the land plot with the surface of 5.9 ha (with the cadaster value of 84 million 253 thousand 50) from production and industry to agricultural and alienated it to his firend M.M. under a formal sale and purchase agreement for AMD 400 thousand 500, thus causing a property damage of AMD 83 million 852 thousand 550 to the community.

As a result of commission of alleged crime a property damage in the amount of AMD 537 million 802 thousand 150, wherefrom AMD 474 million 949 thousand 600 was recovered during the preliminary investigation.

Measures are taken to fully recover the damage caused to the community.

The Prosecutor’s Office, in the scope of the powers of initiating a claim on state (community) interest protection, submitted claims to the Administrative Court with demands to overturne non-legitimate administrative acts regarding the alienation of the land plots listed as roads and sidewalks in the master plan and afterwards sold to M.M.
