New public criminal prosecution against M.P., the former Chief Compulsory Enforcement Officer

On August 23, 2023 the prosecutor initiated a new public criminal prosecution against M.P. the former Chief Compulsory Enforcement Officer.  

 

M.P. is charged with the legalization of property in especially large amounts received through crime (money laundering), appropriation of property in especially large amounts entrusted to him (5 counts), misapplication in especially large amounts by using the official power and through the abuse of official power (2 counts).

 

Particularly, from June 11, 2008, M.P. holding the position of the Chief Compulsory Enforcement Officer, appointed E.S., his bodyguard to the position of the First Category Counsellor of the Operative Division of the Compulsory Enforcement of the Compulsory Enforcement Service of the Ministry of Justice (Service) on September 12, 2008, however instructed E.S. to ensure only his personal safety. As a result during 2008-2016 E.S. failed to carry out the obligations stemming from the position of the first category counsellor of the Operative Division, and based on the assignment of M.P. received salary and other equivalent payments in the amount of AMD 22 million 117 thousand 820.

 

In another case M.P. appointed H.B., his personal driver to the position of the Leading Counsellor of the Operative Division of the Service on November 3, 2009, however instructed H.B. to ensure only his personal safety. As a result during 2009-2016 H.B. failed to carry out the obligations stemming from the position of the Leading Counsellor of the Operative Division, and based on the assignment of M.P. received salary and other equivalent payments in the amount of AMD 21 million 754 thousand 643.

 

Besides that, during the period of holding the position of the Chief Compulsory Enforcement Officer of the Republic of Armenia, M.P. participated in the management (therough authorized persons) of the following companies carrying out enterprenioral activities—“Catherine Group”, “Best Realty”, “Kecharis Hotel”, “Frutimex”, which was associated with sponsoring these organizations by providing privileges and benefits.

 

In another case, in 2013 abusing his official powers M.P. caused essential damage to the rights and legitimate interests of claimants H.A and R.H., by holding an auction in violation of the established procedure. Particularly, 166 transportaion means were sold at lower price during the auction and the claimants H.A. and R.H. were deprived of the right to receive USD 13 thousand 500 and USD 87 thousand 500 compensation after the realization of the property belonging to the debtor during the enforcement proceedings.

 

Based on the abovementioned, on 23 August 2023 the supervising prosecutor initiated a new public criminal prosecution against M.P. under point 3 of part 3 of article 256 of the Criminal Code (5 counts), points 1 and 3 of part 2 of article 179,  part 2 of article 308 (2 counts), part 3 of article 309 and point 1 of part 3 of article 190 of the Criminal Code adopted on 18.04.2003.

 

Notice:  A person charged with any crime shall be presumed innocent until proved guilty in the manner prescribed by the RA Criminal Procedure Code—by the judgment came into legal force.
