The personnel of the N rifle battalion of the military unit of the Ministry of Defense was put on combat duty in the protection sector of the state border of Chakaten - Shikahogh - Tsav - Nerkin Hand sector of Syunik region.

H.M., the commander of the N platoon of the N rifle unit of the same battalion, was appointed the captain of militant base and was serving in the N combat position.

On September 13, 2022, from 00:05, the Armed Forces of the Republic of Azerbaijan attacked the combat positions.

During the battle, H.M., violating the rules of being on combat duty, did not perform his duties properly and, without fighting and reporting to his superiors, as well as informing his subordinates about the situation, left the militant base alone, retreating to Nerkin Hand.

On June 20, 2023, the supervising prosecutor initiated a public criminal prosecution against H.M. under Article 540(6) of the Criminal Code.

On July 6, 2023, the prosecutor submitted the case files along with an indictment to the Criminal Court of the First Instance of Syunik Region.
